Definitions

‘we’, ‘our’, ‘us’ means Samasti Yoga School;
‘you’ means you or any person making a booking on your behalf;
‘Course’ means a 200 hour yoga teacher training course booked with Samasti Yoga School, or booked through a third party by you or by any person on your behalf.

‘Force Majeure’ means any circumstances which are unusual or unforeseeable, or both, and which are beyond the control of Samasti Yoga School.

‘Major Change’ includes one or more of the following when made before the first day of the Course: (a) a change of venue for the whole or a major part of your Course; (b) a change of accommodation to that of a lower official classification for the whole or a major part of your Course; (c) cancellation of the Course because the minimum number of participants was not met.

‘Student Contract’ means the contract that sets out the Course principles, the attendance policy, the daily routine, class times, meals, evaluation and certification. You will be asked to sign it on the first day of the Course, and a copy is available from us on request before you book.

‘Website’ means www.samasti-yoga.com

1. Initial Booking

When you make a request to book with us, either directly or through a third party, you accept these booking conditions and the terms of the Student Contract. Your booking is complete once you have made the initial deposit. Please make payment in accordance with clause 2 below. Once the appropriate payments have been made we will send you an email confirming receipt. Please check that confirmation when it arrives, and tell us immediately if anything in it is wrong, as it may not be possible to make changes later.

2. Paying for your Course

2.1 A deposit of 500 USD reserves your place. Your place is not reserved until we have received it. Once paid, the deposit is non refundable in every circumstance except the one described in clause 5, where we change or cancel the Course ourselves. The deposit covers the costs we commit to in advertising your place and processing your booking.

2.2 The balance of the Course fee is due 40 days before the first day of the Course. You may pay it earlier if you prefer, in one payment or in two, as long as the full amount has reached us by that date. International transfers can take several days, so please allow for that.

2.3 If you book 40 days or fewer before the first day of the Course, the full fee is payable at the time of booking unless we agree something else with you in writing. Your place is not held until we have received it.

2.4 If the balance has not reached us by the date it is due, we may release your place and treat the booking as cancelled under clause 3. In practice we will contact you first.

2.5 We accept payment by bank transfer and by Wise, and by card through our website where that is offered. Prices are shown in United States dollars and in Indonesian rupiah. Any bank charge, card fee or currency conversion cost is yours, and where we refund you, we refund the amount we actually received, less any transaction fees we have already paid.

2.6 We are happy to agree a payment plan. Please ask us before you book. An agreed plan is set out in writing and replaces the dates in clauses 2.2 and 2.3.

2.7 Please do not book flights until we have confirmed by email that your payment has been received in full. If you have booked flights and we later cancel the Course under clause 5, you will need to claim the cost of those flights from your insurer.

3. Cancelling your Booking

3.1 You may cancel at any time by emailing info@samasti-yoga.com. We regret that we cannot pay any expense, cost or loss you incur as a result of cancelling.

3.2 If you cancel more than 40 days before the first day of the Course, everything you have paid beyond the deposit is refunded to you, less any transaction fees we have already paid. The deposit itself is not refunded, but we will hold it and put it towards another Samasti course that begins within one year of the Course you originally booked. If that course costs more, you pay the difference, and if it costs less, the difference is not refunded.

3.3 If you cancel 40 days or fewer before the first day of the Course, no refund is due and the amount you have paid cannot be transferred to another course. Should this happen, we will make an effort to find someone to take your place, and depending on the circumstances we may then be able to offer you a partial or even a full refund. This is at our discretion and it is not something you can rely on when you book.

3.4 If you leave the Course after it has begun, for any reason, or if we ask you to leave under clause 9, no refund is due and nothing you have paid can be transferred.

3.5 If we cancel the Course or make a Major Change, clause 5 applies.

4. Changing Your Booking

If after our confirming receipt of payment by email you wish to change your booking in any way, we will do our utmost to make these changes, but it may not always be possible. Please note, if you are booking on behalf of a group and only some members of your party cancel, you may have to pay the extra room charges such as single room supplements.

5. If We Change or Cancel Your Course

We begin planning the arrangements we offer many months in advance and so we reserve the right to make changes to and correct errors in the Course details both before and after bookings have been confirmed. We must also reserve the right to cancel confirmed bookings at any time. For example, if the minimum number of participants required for a particular Course is not reached we may have to cancel it. Most changes are minor but occasionally, we may have to make a Major Change. If we have to make a Major Change or cancel, we will tell you as soon as possible and we will offer you the choice of the following options:

Accepting the changed arrangements; or

Purchasing an alternative Course from us, of a similar standard to those originally booked if available (if the chosen alternative is less expensive than your original one, we will refund the difference but if it is more expensive, we will ask you to pay the difference) ;or

Cancelling or accepting the cancellation in which case you will receive a full and quick refund of all monies you have paid to us.
Due to the unpredictability of Force Majeure events we shall not be liable for any changes either before or during the Course, which in our opinion are necessary to protect your safety. In this event, we will offer you suitable alternative arrangements, or, if you do not travel, return the monies you have paid us.

6. Your Health and Fitness

6.1 This training is physically and emotionally demanding. It runs six days a week for four weeks and includes daily physical practice, breathwork, meditation and somatic work.

6.2 You must tell us, in writing and before the Course begins, about any injury, illness, medical condition, medication, mental health condition, pregnancy or recent surgery that could affect your participation, and you must tell us if anything changes before you arrive. We treat this information in confidence and use it only in order to teach you safely.

6.3 By booking you confirm that you believe yourself fit to take part. If you are unsure, please speak to your doctor first. We may ask for medical clearance before confirming a place, and where we reasonably believe that we cannot keep you safe on the Course, we may decline or cancel the booking.

6.4 You are responsible for working within your own limits during the training. Please stop, rest or step out of any practice at any time.

6.5 The anatomy teaching on this Course is delivered by a registered physiotherapist, and the training includes somatic and trauma informed material. This is yoga education. It is not physiotherapy, medical treatment, psychotherapy or counselling, it does not create a clinical relationship between you and your teachers, and it is not a substitute for professional care.

7. Hands on Adjustment and Consent

7.1 Teachers on this Course may offer physical adjustments to help you find a posture or to keep you safe.

7.2 Every adjustment is offered with your consent. You may decline any adjustment at any time, for any reason or for none, and you do not need to explain yourself. You may withdraw your consent at any point in the Course, including after having previously agreed.

7.3 Please tell us at the start of the Course, and at any time afterwards, if you would prefer not to be touched. Nothing about your training, your assessment or your certificate depends on your answer.

8. Insurance

8.1 You must hold medical or travel insurance that covers you for medical treatment, emergency care, hospital costs and repatriation for the whole of your stay, and that covers participation in yoga and physical activity. Please bring the policy details with you and give them to us on the first day, so that we know who to contact if something happens to you. Samasti Yoga does not provide medical cover, evacuation cover or any other insurance for you.

8.2 We also strongly recommend that your policy covers cancellation and curtailment, and that you arrange it as soon as you book rather than shortly before you fly. Your place is held for you and the costs of running the training are committed months in advance, which is why our cancellation terms are firm. If you have to cancel for a reason an insurer would normally cover, such as illness or a family emergency, a cancellation policy is what gets your money back, and we cannot do that for you.

8.3 Choosing a policy that suits you, and checking that it covers the amount you have paid us, is your responsibility. We cannot advise you on insurance.

9. Conduct on the Course

9.1 You are joining a small residential group. We ask everyone to treat the teachers, the staff, the other students and the property with respect, to arrive on time, to take part fully, and to keep what other people share in the group to themselves.

9.2 We will not accept harassment, discrimination, aggression, unwanted physical contact or sexual attention, damage to property, or behaviour that puts anyone’s safety at risk. Samasti Yoga is a Registered Yoga School with Yoga Alliance and our teachers work to Yoga Alliance’s Ethical Commitment, which covers inclusion, consent based touch, honest communication and the boundaries of what a yoga teacher does. We expect the same standard from our students.

9.3 Where a student’s attitude, behaviour or absence falls short of this, we will say so in writing and give the student the chance to put it right. If it continues, or if the behaviour is serious enough that a warning is not appropriate, we may dismiss the student from the Course.

9.4 A student who is dismissed leaves the accommodation and the Course, receives no refund and no transfer, and does not receive a certificate. We have no further responsibility to them, including for any travel arrangements, and we will not pay any expense or cost that follows from the dismissal. You remain responsible for any damage or loss caused by you during your time with us, and for paying for it within 28 days of us asking.

10. Certification

10.1 Samasti Yoga is a Registered Yoga School with Yoga Alliance at the RYS 200 level. Yoga Alliance requires a school to assess a trainee’s knowledge and skills before it issues a 200 hour certificate, so completing the days is not on its own enough to graduate.

10.2 To receive your certificate you need to attend the full training, take part in the practice and the coursework, teach and be assessed on both of your practicum classes, and meet the standard of conduct in clause 9.

10.3 If illness, injury or an emergency means that you miss part of the training, tell us as soon as you can. We record sessions and we will do what we reasonably can to help you make up what you have missed. Whether that is possible, and how much can be made up, is our decision in each case. Missing sessions because you have chosen not to attend is a different matter and is dealt with under clause 9. Where too much of the training has been missed for us to certify you honestly, we cannot issue a certificate, and no refund is due in that case.

10.4 Your certificate is issued by Samasti Yoga. Registering as a Registered Yoga Teacher afterwards is a separate application that you make yourself to Yoga Alliance, at their cost, and it includes signing their Ethical Commitment. We cannot do it for you and we cannot guarantee the outcome.

11. Passports, Visas and Health Documents

It is your responsibility to ensure that you are in possession of all necessary travel and health documents before departure. We regret we cannot accept liability if you are refused entry onto any transport or into any country due to failure on your part to carry the correct documentation. If failure to have any necessary travel or other documents results in fines, surcharges or other financial penalty being imposed on us, you will be responsible for reimbursing us accordingly. Please make sure that your country’s Visa arrangement with the locale of the course permit you to stay for the entire duration of the course.

12. If You Have a Complaint

In the unlikely event that you have any reason to complain or experience any problems with your Course whilst away, you must immediately inform us and complete a report form whilst on the Course. Most problems or complaints can be resolved while you are away, however if you remain dissatisfied, you must write to us within a reasonable period of time (we would suggest 28 days) of your return to your home giving your booking reference and full details of your complaint. Your complaint should be by email to info@samasti-yoga.com giving your booking information and all other relevant information. If you fail to follow this procedure we will have been deprived of the opportunity to investigate and rectify your complaint. Kindly note however that we are neither obliged to provide another Course nor provide any refund under any circumstances though we will do our utmost to quickly identify and address your concerns and speedily as possible.

13. Our Liability to You

(1) In respect of the Course: We promise that your Course arrangements will be made, performed or provided with all reasonable skill and care. Further, we will be responsible for what our employees, agents and suppliers do or do not do if they were at the time acting within the course of their employment or carrying out work we had asked them to do.

(2) In respect of the Course: We will not be responsible for any injury, illness, death, loss, damage, expense, cost or other claim of any description whatsoever which results from (a) the act(s) and/or omission(s) of the person(s) affected or any member(s) of their party or of any other participant(s) of the course, nor the staff of our hosting venue(s) or (b) a ‘Force Majeure’ or a Major Change event as defined above.

(3) We limit the maximum amount we may have to pay you for any claims you may make against us. The maximum amount we will have to pay you where we are found liable for loss of and/or damage to any luggage or personal possessions (including money) is 50 AUD per person affected unless a lower limitation applies to your claim under this clause.

(4) Local Excursions/Activities/Events: We will not accept responsibility for services or facilities which do not form part of our Course or where they are not advertised in our website eg any excursion you book whilst on the Course.

14. Data Protection/Privacy

In order to process your booking and meet your requirements, we may have to pass your personal details on to any supplier or service provider involved in delivering your Course. In so far as legislation permits, we would also like to hold your information (including any email address), where collected by us, for our own future marketing purposes (for example, to inform you of future courses or offers or to send you our brochure). If you do not wish to receive such approaches in future, please inform us as soon as possible.

15. Special Requests

If you wish to make a special request, you must do so at the time of booking. Although we will do our utmost to meet a special request, the fact that a special request has been noted on your confirmation email or any other documentation or that it has been passed on to the supplier is not confirmation that the request will be met. Failure to meet any special request will not be a breach of contract on our part unless the request has been specifically confirmed. We are happy to advise and assist you in choosing a suitable Course. As some of the accommodation and venues for the Courses we offer may lack even the simplest facilities, such as ramps for wheelchairs, lifts etc, it is important that, when booking, you advise us of any disabilities and special requirements to make sure the Course meets your specific needs. If we reasonably feel unable to properly accommodate the particular needs of the person(s) concerned, we will not confirm the booking or, if full details are not given at the time of booking, cancel when we become aware of these details. We will try to pass any reasonable requests on to any relevant supplier but we cannot guarantee that requests will be met.
